Terms of Service

1. Acceptance
By using TestPersonalityQuiz, operated by OptiScale LLC, you agree to these Terms. If you do not agree, please do not use the service.
2. Service
The service provides quiz previews, paid digital reports, PDF downloads, AI-assisted interpretations, personalized questions, and subscription access where available.
3. Paid Features
Prices, currency, taxes, renewal terms, trial terms, and supported payment methods are shown before checkout. Payments are processed by Stripe.
4. Subscriptions
Subscriptions renew automatically until canceled. Cancellation stops future renewals but does not automatically refund completed charges.
5. Reports and PDFs
Quiz reports, PDFs, tarot, numerology, astrology-style content, and AI interpretations are for self-knowledge, education, entertainment, and reflection. They are not professional advice.
6. Refunds and Access
Refunds are reviewed under the refund policy, product type, purchase date, delivery status, access logs, usage, technical issues, and applicable law.
7. Prohibited Uses
Do not use the service for unlawful content, abuse, harassment, clinical diagnosis, employment screening, consequential decisions, reverse engineering, automated abuse, resale, or unauthorized redistribution.

9. Eligibility and accounts
You must be at least 18, or the age of legal majority where you live, to buy a subscription or paid report. A minor may use free self-reflection features only with a parent or guardian’s authorization. You are responsible for accurate information, account security, activity under your credentials, and promptly notifying us of unauthorized use.
10. License and ownership
We grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the service and purchased output for your own lawful, non-commercial purposes. The service, software, question design, branding, templates, scoring methods, and site content are owned by OptiScale LLC or its licensors. No ownership rights are transferred.
11. User content and feedback
You retain rights you have in content you submit. You grant us a worldwide, non-exclusive license to host, process, reproduce, adapt, and transmit it only as needed to operate, secure, support, improve, and comply with law for the service. Feedback may be used without restriction or compensation, but we will handle personal data under the Privacy Policy.
12. AI and assessment limitations
Outputs may be automated, probabilistic, incomplete, inaccurate, or affected by your answers and context. The service is not medical, mental-health, legal, financial, educational, employment, or other professional advice; it is not a diagnosis, emergency service, background check, or validated basis for high-impact decisions about any person. Seek a qualified professional when consequences matter.
13. Availability and changes
We may add, remove, limit, suspend, or change tests, reports, models, features, providers, eligibility, or technical requirements. We do not guarantee uninterrupted access, permanent availability of a particular test, compatibility with every device, or that stored output will remain available indefinitely. Save copies you need.
14. Suspension and termination
We may suspend or terminate access, cancel an order, or refuse service for suspected fraud, chargebacks, unlawful conduct, security risk, abuse, attempts to bypass limits, infringement, material breach, or as required by law. Sections intended by their nature to survive—including payment obligations, ownership, disclaimers, liability limits, indemnity, dispute terms, and records—survive termination.
15. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” OPTISCALE LLC DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT A PARTICULAR RESULT, INSIGHT, SCORE, OR OUTCOME.
16. Limitation of liability and indemnity
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPTISCALE LLC AND ITS AFFILIATES, OFFICERS, CONTRACTORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITY. OUR AGGREGATE LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID US FOR THE AFFECTED SERVICE IN THE 12 MONTHS BEFORE THE EVENT. You will indemnify us against third-party claims arising from your unlawful use, submitted content, infringement, or material breach. Non-waivable consumer rights remain unaffected.
17. Arbitration, class waiver, and opt-out
Except for eligible small-claims matters, requests for injunctive relief concerning intellectual property or security, and rights that cannot legally be arbitrated, you and OptiScale LLC agree to individual binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules and the Federal Arbitration Act, after first attempting informal resolution for 30 days. Hearings may be remote or held at a consumer location required by applicable rules. No class, collective, consolidated, representative, or jury proceeding is permitted to the extent lawful. You may opt out by emailing legal@testpersonalityquiz.com within 30 days after first accepting these Terms, stating your name, account email, and an unambiguous request to opt out. If this clause is unenforceable for a dispute, courts in Wyoming have exclusive jurisdiction, subject to mandatory local consumer law.
18. Copyright, notices, and general terms
Send copyright/DMCA notices to legal@testpersonalityquiz.com with the information required by law. Wyoming law governs, without regard to conflicts principles, except mandatory consumer protections. These Terms, incorporated policies, and checkout disclosures are the entire agreement for the service. If a provision is invalid, the rest remains effective. Failure to enforce is not a waiver. You may not assign the agreement without consent; we may assign it in a merger, reorganization, sale, or by law. Electronic notices and records satisfy writing requirements where permitted.
19. Payment authority, automated access, and language
By purchasing, you represent that you are an adult legally able to contract and are the payment-method holder or have the holder’s express authorization. You may not scrape, crawl, bulk extract, reverse engineer, benchmark for a competing service, or use our questions, reports, scoring, or other content to train, fine-tune, evaluate, or improve a machine-learning model without written permission. Translations are provided for convenience; to the extent permitted by law, the English version controls if there is a conflict, without reducing mandatory local consumer rights.
